About this settlement

TransUnion credit reports wrongly showed bankruptcy remarks

Summary

Plaintiff alleged Trans Union sold consumer credit reports containing inaccurate bankruptcy information, listing a bankruptcy remark on a credit account when the report had no corresponding public record of a bankruptcy filing within the prior ten years. The lawsuit claims this violated the Fair Credit Reporting Act by failing to assure maximum possible accuracy. Trans Union denies any wrongdoing but agreed to a settlement establishing an $8,310,000 fund. Class members in the No Bankruptcy Group get an automatic $100 payment plus can claim about $1,000 more, while the Aged Bankruptcy Group must file a claim to receive an estimated $350. Benefits are for consumers whose Trans Union reports were sold between January 6, 2020 and January 31, 2023.

Who qualifies

You must be a person residing in the United States or its Territories to whom, between January 6, 2020 and January 31, 2023, Trans Union sold a consumer report to a third party that included a bankruptcy remark on a tradeline but no bankruptcy record in the public record section of that report, and for whom there is no government-held public record of a bankruptcy filing within ten years before the report date. The No Bankruptcy Group consists of members with no locatable bankruptcy filing at all in public records. The Aged Bankruptcy Group consists of members whose only located bankruptcy filings were more than ten years before the report date. No Bankruptcy Group members receive an automatic $100 payment; Aged Bankruptcy Group members must submit a claim to receive any payment.

Suits does not handle payments or process claims. Payments are issued by the claim administrator and typically take 3-6 months.
