About this settlement
Pork processors settle indirect purchaser pork price-fixing antitrust claims
Summary
The lawsuit alleges that pork processors including Agri Stats, Clemens, Hormel, JBS, Seaboard, Smithfield, Triumph, and Tyson conspired to limit the supply of pork and inflate prices through information sharing, production restraints, and exports. The Defendants deny any wrongdoing, but Agri Stats, Clemens, Hormel, Seaboard, Triumph, and Tyson have agreed to settlements totaling $117.065 million in cash, in addition to prior separate settlements with JBS and Smithfield whose claims period has closed. Eligible Class Members who submit a timely, valid Claim Form will receive a pro rata cash payment based on the amount of qualifying pork products purchased. Agri Stats is not paying money but has agreed to reform certain business practices regarding its industry data reports.
